Jeffrey P. Cunningham

Mr. Cunningham is a Partner at Schumann Arevalo LLP heading its Federal and State appellate practice. Mr. Cunningham has over twenty years of experience successfully handling and arguing appeals and writs before the California and Ninth Circuit Courts of Appeal and the Ninth Circuit’s Bankruptcy Appellate Panel in a wide of range of matters, including various types of business litigation, wrongful death, premises liability, property damage, serious personal injury, defamation, privacy rights, and bankruptcy cases. Mr. Cunningham has handled several appeals which resulted in published Federal and State precedent.

Mr. Cunningham is also experienced in all types of civil litigation, from case inception to judgment collection proceedings. He has particular and wide-ranging experience in defending major and catastrophic injury cases, trucking litigation, business litigation of all kinds including real estate, banking, corporate, construction defect, commercial, unfair competition, bankruptcy, and trust cases. He has also prosecuted and defended numerous employment law matters, both for employers and employees.

• Filed and argued numerous appeals of judgments and writs with a high degree of success over twenty years in State and Federal Appellate Courts including several published opinions;

• Lead defendants’ counsel in designated “complex,” multi-million dollar wrongful death and catastrophic property damage case involving over 50 parties

• Obtained summary judgment for boat manufacturer and lender in complex breach of warranty action

• Obtained summary judgment for automobile racing operation in various cases, including in alleged police brutality and premises liability action

• Obtained summary judgment for business in complex, multi-million dollar wrongful death action

• Obtained dismissal in family law action of motion to amend judgment seeking multi-million dollar award of spousal support

• Obtained multiple summary judgments for developer in complex construction defect and serious injury case, including obtaining indemnity for developer against contractor, architect and related parties.
